Visa application procedures for foreign investors in Vietnam

 

LEGAL ADVICE/LEGAL SERVICES ON VISA AND RELATED ISSUES:

As Vietnam is on the pace of global integration and economic development, it is now more and more common for foreign investors to come to Vietnam finding an opportunity to establish or develop their businesses. However, the current legal regulations of Vietnam still require citizens from many other countries to obtain an appropriate visa prior to their entry to Vietnamese territory. For foreign investors, the right visa should be granted with the symbol "DT" and the maximum duration for each visa shall be 1 year (12 months). Investors who wish to stay longer may apply for a temporary residence card for a period of up to 5 years. Recent laws and guiding legal documents have provided quite detailed requirements for an application for “DT” visa as to be specified further under the below sections.

1. Legal grounds

a. Law No.47/2014/QH2013-Law on Entry, Exit, Transit, Residence of Foreigners in Vietnam

b. Circular 04/2015/TT-BCA specifies forms of papers related to entry, exit and residence of foreigners in Vietnam

2. Dossiers for visa application

An application dossier shall include:

a. Certified copy of Business Registration Certificate/ Investment Registration Certificate;

b. Certificate of seal specimen registration or a notice on the publication of information on seal specimen of the enterprise on the national enterprise registration portal;

c. Form NA16 - Registration form for the seal and signature of the legal representative of the enterprise operating in Vietnam;

Note: If companies have already submitted the documents mentioned in Section 2.b and 2.c once, those need not be re-submitted to the Immigratin Office for the subsequent applications.

d. Form NA5 - Application for visa, visa extension, extension of stay for foreigners in Vietnam;

e. Original valid passport;

f. Temporary residence registration form as prescribed;

3. Place of filling and settlement time

- Companies may submit dossiers to the Exit and Entry Management Department or the exit and entry management sections of the police offices of the provinces/city where they are headquartered.

- Time limit for settlement of applications: 5 working days from the date the companies submits complete and valid dossiers as prescribed by law.
